These Terms of Service ("Terms") govern your use of the Profit Pal application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.
The Service connects, on a read-only basis, to trading platforms, prop-firm platforms, and brokerages that you choose to link — directly or through third-party aggregators such as SnapTrade — and displays aggregated balances, positions, and profit & loss. The Service does not and cannot execute orders, transfer funds, or take any action on your connected accounts.
Your connected platforms and brokerages, and aggregators such as SnapTrade, are operated by third parties under their own terms and privacy policies. You are responsible for complying with those terms. We are not responsible for the availability, accuracy, or actions of any third-party service, and connecting an account you are not authorized to access is prohibited.
Some features may be offered free of charge and others may require a paid subscription. If and where paid features are offered through the Apple App Store, payment, billing, renewal, and cancellation are handled by Apple under your Apple ID, and Apple's terms apply. Prices and included features will be disclosed at the point of purchase. Except where required by law or Apple's policies, fees are non-refundable. We may change plans or pricing on a prospective basis with notice.
P&L, balances, and positions are provided for informational purposes and depend on data supplied by third-party platforms. Figures may be delayed, incomplete, or inaccurate and should not be relied upon for trading, tax, or accounting decisions. Always verify with your broker or platform of record.
Nothing in the Service is financial, investment, legal, or tax advice, a recommendation, or a solicitation to buy or sell any security or instrument. You are solely responsible for your own decisions. Trading involves substantial risk of loss.
The Service, including its software, design, and content (excluding your data), is owned by Profit Pal and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use in accordance with these Terms.
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Upon deletion, your data is removed as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR TIMELY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFIT PAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU PAID NOTHING.
You agree to indemnify and hold harmless Profit Pal from claims arising out of your misuse of the Service or violation of these Terms or any third-party rights.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date and, where appropriate, communicated in the app. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in Ontario, Canada, except where applicable law provides otherwise.
